Rules of the Celebration
1. Agreement to Terms
By accessing or using Wishaboo ("the Service", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service.
2. Accounts & Eligibility
To use Wishaboo, you must be at least 13 years of age. By creating an account, you represent that you meet this requirement.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree to notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
3. Credits & Payments
The Credit System
Wishaboo operates on a credit-based system. One credit grants you the ability to create one celebration board with unlimited wishes and forever access. Credits do not expire.
Flexibility: You may delete a board to recover 1 credit back to your account, provided no guest wishes have been submitted to that board yet.
Refunds (Monetary)
Monetary refunds for credit purchases are considered on a case-by-case basis for unused credits within 14 days of purchase. Once a credit has been used on a board that has received guest wishes (and is thus ineligible for deletion), it is strictly non-refundable.
To request a refund, please email [email protected] with your receipt or account details.
Promotions & Free Credits
Wishaboo may offer promotional credits or signup incentives. These are intended for one-time use per individual user.
Notice: Deleting an account does not guarantee eligibility for future promotional offers, free credits, or signup incentives. Wishaboo reserves the right to limit or deny such benefits to prevent exploitation or abuse of the platform.
Account Suspension & Negative Balances
If you request a refund through your payment provider for credits that have already been spent on boards, the refunded credits will be deducted from your account balance. This may result in a negative credit balance, which triggers an automatic account suspension.
During suspension:
- You cannot create new boards
- You cannot edit existing boards
- Your existing boards remain visible to visitors
- You can still delete boards with no wishes to recover credits
To restore your account: Purchase enough credits to bring your balance to zero or positive, or delete unused boards (boards with no wishes) to receive credit refunds. Your account will be automatically restored once your balance is no longer negative.
4. Third-Party Services
Wishaboo utilizes various third-party services to provide the Service, including but not limited to Polar (payment processing), Tenor (GIF search), and PostHog (analytics). By using Wishaboo, you acknowledge and agree that your interactions with these features are also governed by the respective terms and privacy policies of these third-party providers.
5. Content Moderation & Responsibilities
Wishaboo is a platform for celebration. As a board creator, you are solely responsible for the content posted on your boards, including wishes added by your guests.
Prohibited Content
You agree not to use the Service to create boards or post content that is illegal, defamatory, harassing, or promotes hate speech. We reserve the right to remove any content or terminate accounts that violate these terms without prior notice or liability.
6. Intellectual Property
The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Wishaboo. Any content you post remains yours, but by posting it, you grant us a license to host it so you can share it with others.
7. Limitation of Liability
In no event shall Wishaboo be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
8. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. Any changes will take effect immediately upon being posted on this page. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions. Any legal action or proceeding related to your access to, or use of, the Service shall be instituted in a court in Malaysia.
